An Unconstitutional Power Grab

Recently, a disturbing story hit the national mainstream media, although it has been discussed in the blogosphere for quite a while. More recently, the story showed up at the Drudge Report, guaranteeing wider coverage.

Better late than never. It’s good to see that some in the mainstream media are willing to play catch up and to sound an alarm that we’ve been clanging from the beginning of the Obama administration. This particular story involves Obama’s Department of Defense (DOD) and an apparently ultra vires directive they “quietly” issued.

For the Washington Times, Bill Gertz wrote,

“Federal military forces shall not be used to quell civil disturbances unless specifically authorized by the president in accordance with applicable law or permitted under emergency authority,” the directive states.

“In these circumstances, those federal military commanders have the authority, in extraordinary emergency circumstances where prior authorization by the president is impossible and duly constituted local authorities are unable to control the situation, to engage temporarily in activities that are necessary to quell large-scale, unexpected civil disturbances” under two conditions.

The conditions include military support needed “to prevent significant loss of life or wanton destruction of property and are necessary to restore governmental function and public order.” A second use is when federal, state and local authorities “are unable or decline to provide adequate protection for federal property or federal governmental functions.”

“Federal action, including the use of federal military forces, is authorized when necessary to protect the federal property or functions,” the directive states.

Military assistance can include loans of arms, ammunition, vessels and aircraft. The directive states clearly that it is for engaging civilians during times of unrest.

A U.S. official said the Obama administration considered but rejected deploying military force under the directive during the recent standoff with Nevada rancher Cliven Bundy and his armed supporters. [emphasis added to quotes]

Over a year ago, Jed Morey wrote,

By making a few subtle changes to a regulation in the U.S. Code titled “Defense Support of Civilian Law Enforcement Agencies” the military has quietly granted itself the ability to police the streets without obtaining prior local or state consent, upending a precedent that has been in place for more than two centuries.

This is patently unconstitutional. Never mind the president, the U.S. military simply cannot operate within the confines of any state without “local or state consent.”

The United States of America is a REPUBLIC; the federal government has few and limited powers to operate within what is, in essence, a sovereign state. That’s what the Tenth Amendment is all about.

Every governor of every state in the Union should be outraged and should demand that this “directive” be immediately rescinded. Morey quotes civil liberties attorney and constitutional law professor Bruce Afran, of Rutgers University. Afran says this directive

violates the long-standing presumption that the military is under civilian control. … It’s no different than the emergency powers clause in the Weimar constitution [of the German Reich]. It’s a grant of emergency power to the military to rule over parts of the country at their own discretion.

There it is in a nutshell: The military gives to itself the power to make up its own orders. No governor, no mayor, can tell them to stand down. In effect, the military could enact a coup within any state and Obama, having not given the order, could then stand above it all and deny responsibility.

As Morey points out, the military can act under their own directive simply if they can’t reach the President by telephone, ignoring the “statutory chain of succession,” in which command would go next to the Vice President, then to the Speaker of the House of Representatives, and down the line.

Try to imagine a situation in which the federal military would be on the scene of domestic unrest within any state and would be out of reach of the Commander in Chief. Why would the military be present in a state without the permission of or at the request of the governor of the state? It boggles the mind.

States have their own militias to defend themselves against civil unrest. They’re called the National Guard and they are under the command of the governors, not the U.S. military. Neither the president nor the military can intervene militarily in any state without the permission of that state’s governor.

Here is the plain text of the Constitution of the United States of America regarding federal power to quell domestic violence:

Article. IV. Section. 4:

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence.

Just the fact that the “Obama administration” considered intervening with troops in the Bundy standoff is alarming. Had the “Obama administration” deployed military force against Bundy and his supporters, without permission of the Republican governor of Nevada, then this constitutional issue would have come to a head, which the administration surely knew, which is probably why they declined to do it. Is Obama “quietly” arming all manner of Executive Branch agencies and biding his time, hoping that no one will challenge this directive until the other shoe drops?

Other agencies with SWAT teams reportedly include the Department of Agriculture, the Railroad Retirement Board, the Tennessee Valley Authority, the Office of Personnel Management, the Consumer Product Safety Commission, the U.S. Fish and Wildlife Service and the Education Department.

Surely Obama, a lawyer (although unlicensed) and an erstwhile “constitutional law” lecturer, knows that this DOD directive violates the Constitution, which guarantees every state a “Republican Form of Government.” The directive also appears to violate the Insurrection Act of 1807 and the Posse Comitatus Act of 1878 (PCA). Violation of the PCA is a punishable offense. It’s a federal crime, but who cares about the law and the Constitution?

It is the habit of the Obama administration to act first (e.g., not enforcing laws, granting “amnesty” to illegal aliens) and then to dare someone to challenge the actions in court. As he knows and counts upon, litigation takes time, and Obama is very good at running out the clock. With luck, given a friendly progressive judge, he might even persuade the Court that no citizen, or even any state governor, has “standing” to challenge his Weimar Republic-like “directives.”

Even when  lower courts rule against Obama, he simply continues on until the case goes all the way to the Supreme Court, hoping that if they rule against him, by then it will be difficult if not impossible to roll back his previous actions. Such is the case with the unconstitutional recess appointments to the National Labor Relations Board.

In the meantime, Obama and his administration continue to do whatever they want, with no apparent attempt by Congress or the Courts to stop them. Whether by unlawful “executive orders” or by simply ignoring laws enacted by the duly-elected representatives of the People, Obama steamrolls over the rule of law and continues to set himself up as “King Obama“.

Morey says,

Changing this rule now requires congressional or judicial intervention.

Let’s hope that intervention comes soon. Impeachment would be an option, but it’s unlikely to happen so long as the Democrats control the Senate and continue to march in lockstep with Obama, looking the other way as he grabs all the unconstitutional power that he can.


Postscript:  Bruce Afran was a party to the lawsuit Hedges v. Obama, which was denied certiorari late last month by the Supreme Court. The suit sought to prevent the government under Obama from detaining people indefinitely if they were suspected of supporting terrorism or engaging in “hostilities” against the USA.

I’m beginning to think that WordPress doesn’t like us. 😦 I noticed that the comments we put on “Links” (as usual) don’t show up on the comments sidebar, so people know to go there to read them. I have tried to figure out why, but no luck so far. I think possibly WordPress changed the whole system since that post was put up and somehow that messed things up.

          The thing I’ve always liked about Links is that it serves as an archive for matters that may not pertain to the current post., but will be handy in the future. In this case, (comment below) the Secretary of Interior would fit with the article, per se, but on a broader range, e.g. land grabs, regulations designed to control, etc., so I filed it. Most interesting, imho. (not that its all that humble 🙂 )

    • Well, you know, it’s only “fair” which is why Mooch is trying to force all kids to eat as well as hers but ON THE TAXPAYERS’ DIME. Actually, now that I think about it, it wouldn’t surprise me in the least to learn that somehow, some way, We the People are paying for that school and the luxe food for her kids. We lived “deprived” lives, but her kids don’t get peanut butter sandwiches. (Somebody might be allergic.) What’s with all that “Brazilian” food? Is there something special about Brazil? Surely it’s just a fancy adjective because dollars to forbidden doughnuts, the country of Brazil (responsible for cutting down the rainforest and increasing global climate disruption) is loaded with pesticides and fertilizers. How else do you grow crops on poor, dessicated soil?

All that food tossed into the trash because the schools MUST give it to the kids even if the kids and the “lunch ladies” KNOW it’s going right into the garbage.       This is what Mooch considers a “problem”. That FREE WOMEN who have children over whom THEY are the sole “deciders” independently decide to eat white potatoes in quantities that SHE, Queen of the Universe, thinks is “enough”. This woman has NO constitutional role in this government. She has no “job”, although she believes she’s the First Mother of All. “Let them eat ‘nutrient-dense fruits and vegetables'” paid for by the taxpayers, never by Mooch herself. MANDATED “nutrient-dense fruits and vegetables”. Have you ever eaten kale? Ever just SMELLED it cooking? No wonder kids won’t eat it.

    • Yes, those phony documents contain all the information necessary for the State Dept. to issue a passport, just like Barry’s “short-form certification of live birth”. The more we look at this, the more pertinent that ridiculous statement by FactCheck blog was. We were talking eligibility; they were talking the State Dept. and passports. At the time we wondered why. We soon after noted the timing of that passport breach and the taking of the photos of the SFCOLB in the Chicago CAMPAIGN HEADQUARTERS. But now we see the Indonesian connections and all those discrepancies. After that passport file breach, suddenly Barry mentions overseas travels he took after the age of majority. (This may also be why it’s important to fudge the date he first traveled to Kenya. For some reason, he didn’t want anybody to know that he was traveling to Kenya around the time that he would need to reaffirm Kenyan citizenship in order to keep a Kenyan passport, if he had one.) Before that passport breach, he didn’t mention those travels he took right after he would have had to stop traveling on Mom’s or Dad’s passport and get his own. Was a bogus SFCOLB put INTO his passport files because it would be necessary to pretend that when he reached 21 he had given the “State Dept” all the information necessary so they COULD have issued a U.S. passport to Barry Obama so he could go to PAKISTAN in 1981, when in actuality they did NOT give him one then and he traveled on a different country’s passport?

    • It is totally beyond belief, I’m sorry, that he could have “hacked to death” three young men, all of whom were at least as healthy and strong as he was, when in fact he was small, wimpy, and shy. It was early evening. Not a time when they’d be asleep. One of the young men was visiting the others so, presumably, at least two of them were awake. How could a small, wimpy, shy, introverted loner hack to death three other young men, without ANYBODY else in the building hearing a thing? Without any of the others crying out? Did two stand by and wait their turn? They need to give the public a plausible scenario here. How could he have done this? What were the parents of those three young men told? Does it make sense that none of them asked for an explanation? I’m not saying they didn’t; I’m saying that it’s PROBABLE that they did. Wouldn’t you? So what were those families told and why hasn’t the public been told? As with Sandy Hook, there will be no trial, no need to hide evidence lest a trial or witnesses be contaminated. Speaking of which, have you seen the photos of the convenience store employees cleaning up the blood themselves? No HAZMAT, which is REQUIRED by law. No crime scene tape, either. Just a few guys with mops. Pristine row of potato chip bags behind on the lowest shelf. No blood spatters. How’d you like to buy those chips? It makes no sense.

Was it all scripted and executed as with Sandy Hook, except in full view of the public (like Boston) with people kept at a distance so they couldn’t determine what was real and what was not? Another example: the storyline is that he drove to the convenience store, got out, WENT INTO the store and then began shooting. And yet the ubiquitous photos of the plate glass window show bullet holes that came FROM THE OUTSIDE. And then, there’s allegedly live video of the clerks and customers crouching down and yet, miraculously, they release no footage of the shooter from inside the store, where he was allegedly shooting. I said before: try to find that particular victim in searches. Of course, he has several names. Where’s the mother?

[Who was the co-owner, one wonders?]

      Spree killer Elliot Rodger named Sophy as his psychiatrist in a typed 138-page manifesto sent to KEYT-TV and other media outlets prior to the 2014 Isla Vista killings. About thirty other people received emails with attachments of the manifesto, including Sophy.

    • How I long for the days when we didn’t make deals with terrorists and give in to hostage-takers. Remember when the DemoncRATS screamed to high heaven about “arms for hostages?” We’re giving them criminal, American-murdering terrorists for one hostage. I’m thinking back to the arguments progressives made when some didn’t want women in combat roles or even in combat areas where they might be captured, raped, tortured, killed. They said that this is what all members of the military willingly accept–the danger involved in standing up to defend our country. So the same could be said about Bergdahl. It sounds cold but it goes with the territory. Doesn’t it? I’m glad he’s released, but at what price? I wonder how the man himself feels about this deal. If the terrorists go on to kill others, then what? Does giving in to the terrorists who held him simply ENCOURAGE them to take more hostages and thus put more of our people at risk? I’m surprised Barry didn’t give them the Blind Sheik who, of course, was probably supposed to be traded for a higher profile person–like Chris Stevens. God bless, Bergdahl, though.       A TRIUMPH by Barry to give in to terrorists and hand over HIGH-PROFILE TALIBAN COMMANDERS, INCLUDING THE HEAD OF THEIR ARMY. That’s a TRIUMPH? Only if you want to have “your people” freed. Maybe he’s afraid his time in command is waning and perhaps he doesn’t have another 3 years if the Republicans take the Senate, so he’s going to push through everything he can before November. Will he begin to issue pardons, too?

      It figures, too: BARRY BROKE ANOTHER LAW by not notifying Congress 30 days before he released people from Guantanamo. He’s going to empty the place.

      WHAT, if anything, will Congress EVER DO about this blatant disregard for the law and Constitution and blatant disrespect of the People and their representatives?

      • We’re supposed to believe they didn’t notify Congress because suddenly, after he was a prisoner for 5 long years, they needed to act quickly to “save his life.” Doesn’t pass the smell test but, as usual, Barry will nudge, nudge, nudge, ignore all laws and restrictions on himself, push the envelope and the spineless wimps in Congress will not stand up, to our detriment and the detriment of our country for who knows how long, provided the country even survives this administration.

        • Can we presume that “Mullah Mohammad Fazl, a former Taliban deputy defense minister,” may have been directly involved in planning and executing the murder of nearly 3000 Americans and Barry just traded him and 4 other murdering thugs for one man who oddly enough walked off the military base and into the arms of the enemy, for what reason nobody knows?

She described Bergdahl as a sensitive young man who “questioned everything” and who went to Afghanistan because he wanted to help people.

          “Now the only thing I can think of worth talking about is protecting him from people criticizing him and trying to find a negative source of why he left in the first place,” she said.”


            “… According to a 2008 Pentagon dossier on Guantanamo Bay inmates, all five men released were considered to be a high risk to launch attacks against the United States and its allies if they were liberated. The exchange shows that the Obama administration was willing to pay a steep price, indeed, for Bergdahl’s freedom. … In the initial statements released about the deal, the White House declined to name the detainees who would be leaving the Cuba based prison Obama has been trying to close since his first day in office.

            A senior U.S. defense official confirmed Saturday that the prisoners to be released include Mullah Mohammad Fazl, Mullah Norullah Noori, Abdul Haq Wasiq, Khairullah Khairkhwa and Mohammed Nabi Omari.

            While not as well known as Guantanamo inmates like 9-11 mastermind Khalid Sheikh Mohammed, the Taliban 5 were some of the worst outlaws in the U.S. war on terror. And their release will end up replenishing the diminished leadership ranks of the Afghan Taliban at a moment when the United States is winding down the war there. …”

            I’m sick to my stomach. The parents of the released soldier just happened to be in DC, the story goes, so they were there for a victory photo op with Barry.


              “… Perhaps the most telling revelations come from his last email to his parents, sent three days before his capture, in which Bergdahl seems completely disillusioned with the war effort.

              “The future is too good to waste on lies. And life is way too short to care for the damnation of others, as well as to spend it helping fools with their ideas that are wrong… I am ashamed to even be american. The horror of the self-righteous arrogance that they thrive in. It is all revolting.”

              “In the US army you are cut down for being honest… but if you are a conceited brown nosing shit bag you will be allowed to do what ever you want, and you will be handed your higher rank… The system is wrong… the title of US soldier is just the lie of fools.”

              The US army is … the army of liars, backstabbers, fools, and bullies... I am sorry for everything here. These people need help, yet what they get is the most conceited country in the world telling them that they are nothing and that they are stupid, that they have no idea how to live.”

              “We don’t even care when we hear each other talk about running their children down in the dirt streets with our armored trucks… We make fun of them in front of their faces, and laugh at them for not understanding we are insulting them.” …”

              • Please somebody tell me why this sudden push to act AS IF he cares about our military, the vets, and being Commander in Chief? He’s going to Normandy next week. Did you know that? West Point and then D-Day in Normandy. Big deal in France for the anniversary. WHAT is he up to? Any guesses? Is it just to get the poll numbers up and hope that he won’t be “shellacked” again in November?

                    As I stated on Facebook I could tell you stories about this guy he was in my battalion he walked off the COP with 3 bottles of water and a pocket knife. We had to sign papers that stated we couldn’t talk about it back at the time of the initial investigation we couldn’t say a word right after getting back from Afghanistan about it. We spent months looking for this guy, I know several people injured and a few died because of this douchebag! It was a huge scandal, no soldier was aloud to talk about it because brass didn’t want the media depicting the truth. The Government had its fingers all in it another reason why I got out 2 years later.
                    I’m curious to read all the comments, but after reading this one, I’m thoroughly sick. We’ve been coup’d by foreign installation by the power invested to CJ SCOTUS. January 20 and 21 2009.
                    Benghazi before our eyes. And its nothing more that a toy. a rattle.

What gets me is that he’s spent weeks kissing up to the military and plans to spend next week doing the same and yet he seemingly destroys all good will by trading someone that many in the military consider misguided, if not a traitor, for HIGH-RANKING TALIBAN LEADERS who were waging war against our troops and who ARE RESPONSIBLE FOR THE DEATHS AND MAIMING OF THOUSANDS OF AMERICANS AND THEIR FELLOW TROOPS.     My questions of this are–just who did Hagel contact or call in the Taliban to make this arrangement and how did he know who to contact?

    Was this done as another distraction to the VA—and get the military and citizens back on his side?

    It was reported that 12 navy seals were sent in to make the exchange with 18 Taliban.

    And Bergdahl was held for nearly 5 yrs why? Why weren’t the seals sent in to get him out a long time ago.

    Also Bergdahl was in country for a few months before this happened and the story is he Wandered away from the Base–come on now, our troops are trained and he knew not to leave the base–so was it Deliberately Planned this way?

    • The “administration” actually believes they didn’t negotiate with terrorists because they had the Qataris do it for them! So Hagel called Qatar and Qatar made the deal. Or Kerry did. I’m sure he had his own US-hating self involved. I’m sure it was to distract from the VA scandal or else at least moderate the fallout.

      Did you see how all the stories today claim that the VA problem goes back to GWB’s time? Nope. It doesn’t. It was identified during his time and he put in place the system that the Obama people were “gaming” to NOT use the computer and to keep a separate set of books. The wait times did go back to Bush’s time; the FRAUD didn’t. That’s all Barry’s and THAT’S a big part of this scandal.

      In addition, the wait times doubled or quadrupled under Barry. What was weeks is now months to a year to get an appointment. Barry won’t want to solve this problem because the very people who made the second set of books are probably predominately “his people”. At least that would be true in the VA hospital I’m familiar with. He doesn’t want to mess with public employees, who are his reliable voters, especially to make them WORK or call them on the carpet for errors, fraud, indolence, or whatever else caused this situation. It sure wasn’t competency.

      I think Bergdahl was held all that time for just this purpose. To be used to allow Barry to release the worst cases out of Guantanamo. Now that they’re gone, it will be a piece of cake to get rid of the rest of them and close the place down. He’s not going to let those people stay there past the end of his presidency. He just won’t. Not because he promised to close it but because he WANTS them all to go free.

      • I don’t know. Too many issues to pick which one was the target. With our current political system, I would think that Ed Rendall would be a little concerned. I thought I heard on ABC World News tonight that he was supposed to be on that plane and did not go at a last minute change. I’ve looked for the video of that broadcast and cannot find it. So many scary things involved. The fight over the newspaper, pro sports, NJ, Atlantic City, politics, and they met to discuss some education initiative, just to name a few. What was that initiative? Too many strange plane crashes. Senator Inhoff’s son comes to mind.

        • I know. Ed Rendell is one lucky guy, though. I heard him say he was asked to come on the plane but he couldn’t (or declined) for some reason.

  22. Ugh! With drudge reporting Cruz won 2016 straw poll, conservative blogs’ forums are having orgasms over the possibility he will run and how hopeful it is. I see some major sites have been gas lighting their fellow conservatives on this. When Cruz first made headlines and the Right fell in love with him, many spoke up on comments that he was not qualified and shared why. Gradually, when the topic came up, less and less warnings about not being eligible were put through. Today, nobody gets through with the comment and conversation is void of the in eligibility as if it is fact he can and should be president. I know people have tried to comment the fact that not constitutionally qualified but comments do not go through. That is there right to block but what I find irritating is that they are so Tea Party Patriot and Truth Bearers AND know the truth but want their readers/followers to go for Cruz. Why? When they KNOW he is not qualified?

    • Traitors on both sides. It seems that nothing is as is seems anymore. FR is censoring all comments about Cruz eligibility. I have lost all respect for a blog that I once admired.

      • It appears The Conservative Treehouse and Legal Insurrection are also. Now, maybe they are not but I know there have, in the past, been devoted commentators to piping up that he is not eligible and now, this last time around, nada, nothing. No rebuttal. LI had put out an article explaining why they, in the professor’s legal opinion, Cruz was eligible and many, many logical and factual information was presented. Since then, whenever Cruz comes up there are no rebuttals or corrections stating he is not eligible. I know waaay too many Patriots that won’t let it go unsaid whenever Cruz is pushed for president that he is not eligible for no comments from the Cruz-naysayers. I am confident they have not just ran away from these places and others. In true gas lighting fashion a comment or two, as it is noticed and accusations of gas lighting are known, may just have to be put through to make the “noticers and accusers look hateful, spiteful, and petty. Those defending, teaching, and sharing on eligibility are being exiled from blogs as IF we are a minority and not valid Partriots. These types of blogs lambast the Left for not being transparent, for their Alinsky tactics, and for gaslighting-just saying and acting something is reality until it is assumed as such, but are expert at the same tools as the Left to destroy the individual “think”. This is worse than the Left as far as I am concerned because the Left openly attack for their agenda; these conservative blog leaders do so while playing on the conservative team. Start noticing, and add to the list of FR, CTH, LI, It would be curious exercise and important to know the enemies within the enemies within, so to speak. Now, I am NOT saying those that disagree with Cruz eligibility are enemies. However, those that are gas lighting and imagery to push such a serious breech of the Constitutiton, need to be seriously considered as …………….(not ready to call traitorous or Left or usurpers or anti-American as can’t believe it about most of them. Just can’t. BUT there is usually a leader on these blogs, and not necessarily the obvious persons, that are using mind-control warfare techniques to be sure people do not even have the opportunity to think Cruz might not be eligible. It appears they want to protect their new followers from the information. I am afraid, Kathy, there are proving to be more sites you are going to be disappointed in.           • Also, if you google, you will see the subject of Cruz being eligible ceased in Summer 2013. Since then, not much. The issue has been settled because of places like those mentioned above. AND THEY KNOW HE IS NOT.

            • I know one reason for distaste for Red Pill is (should say ‘was’ as my conversation is dated and time does change people) he is an articulate “birther” and his comments are just too darn orderly and logical to be debated and if a blog owner does not agree they can not flatten his presentations within the comment sections and more will see as RP does. One time Sundance thought he had the perfect way to discourage the talk of ineligibility on a blog by presenting the disclosure of fraud would create a constitution crisis and basically, all hell would break loose; like in just trying to undo all the laws and stuff. He was appealing the the moral side (responsibility) to mold people’s thinking away from the focus of ineligibility. He was very impressed with his presentation and was a little prickly when some disagreed and his spin was not a deterrent. On CTH most birthers have been banned or expelled, albeit the reasons were always for “something else”. Also, Only me, but I sense a taunting behind the recent post of acting like their is no issue with Cruz being president, as if his running is a very ordinary thing. The scripted sing-song of the comments makes one wonder if just using to see who of the regulars are not on the bandwagon. It feels like gaslighting at its best. I don’t literally mean this blog but wtpotus is now synonymous with those that just won’t give it up on Obama not being eligible, so a link to here in the comment section would not last very long there, I suspect. For all the ‘truth has no agenda’ the site does not list wtpotus in their blogroll and it is just too unimaginable that NO comments stating Cruz not qualified were presented. Too many people have put too many hours into studying nbc to just walk away and not correct and educate when the “rahrah Cruz” starts. The Left tried to quiet the “dissent” on this. They were not successful in stopping the spread of the truth, the facts as to nbc. However, the Conservatives (and not RINOs but slef-proclaimed tea party leaders) took the ball and have all but silenced the issue on the internet. Now, think about CTH role in that? The site is more likely to put a few trolls through than anything saying Cruz is not eligible.

              Some days their are so many links here to CTH I step back and take a breather and check out for a time. Most of what gets linked can be found elsewhere on net for an alternative link to get the news out. I could say more but I have already put my foot in my mouth far enough. I appreciate all you guys do. How ironic, though, someone comes here find a link to the CTH and then reads how all the cool people are talking with no mention of not being a nbc, like he is one and if he is one, what does that make everything the person just read at wtpotus? They see no one is talking about what they just read at wtpotus, and by gosh, “these people here at CTH are in the know. Their truth has no agenda. They would know if Cruz was not eligible and would fight for the truth if he was not a natural born citizen.” (Oh, and I KNOW Sundance KNOWS the meaning of Natural Born Citizen as born to two US Citizens, meaning they both were citizens at the time the child was born.)

                I did link to CTH three times in a row the other day, but I didn’t realize it would offend anyone, even though I know RP had a falling out with them. It wasn’t my intent to offend him or anyone else by reading their stuff or linking to it. If I see a good story somewhere, then I link to it, and I guess I feel it’s only fair to link to the place where I found it.

                I wondered that very day how it is that one person (SD) can find so many good links and also have the time and ability to write so many posts in one day. I’m lucky if I can find time to write two posts a week, although if I spent more time posting and less reading and commenting, I might be able to do more. But I do have a life outside the blog. Maybe some others don’t, or maybe that’s their job or someone is a “committee”. They do have advertising, and we don’t. And they also appear to collect donations, making them something altogether different from us. I don’t think of them as the “cool kids”, nor do I think that what they write detracts from anything we say. I actually welcome a discussion and other points of view, so long as people follow the comment rules (no personal attacks, no flaming, no cut and pasting the same thing ad nauseum, etc.). I don’t take offense when people disagree with me and I don’t try to enforce a “no dissent” rule on any topic. I actually dread Cruz’s potential candidacy because I have a more nuanced attitude at this point. However, I hope so much that the Republicans don’t, once again, shoot themselves in the foot by nominating the WRONG person (e.g., Jeb Bush, Cruz, Jindal, or anybody who is NOT without a shadow of a doubt a NBC).

                I’ve said many times before that Cruz needs to man up and go to wherever he needs to go to get a definition of NBC settled because the boundaries have already been pushed to the breaking point.

                My argument with Barry isn’t over the definition of NBC but more over whether he fits ANY of the definitions offered. We don’t know the truth about his circumstances so there’s no way to even begin a process of seeing if he meets ANY of the definitions. It’s putting the horse before the cart.

                First we need to know WHO HE IS. Then, when we have the TRUTH about his origins, we can see if he’s eligible. This is what should have happened when he first ran. The FACT that they have done everything possible to keep a true vetting from happening IS our answer. He’s not eligible, or at least they suspect he’s not, and so there’s our answer. It’s not even a precedent, because THAT can’t be determined, either, until we know the truth of who he is.

                President Eisenhower had to prove his eligibility, so why didn’t Barry? The trouble with Cruz is that we KNOW who he is and where his parents were born and where he was born and that’s because he’s an honest person, I suppose, unlike Barry who lies and obfuscates about his parents, birth place, etc.

                So as with everything, conservatives, Republicans, and MORAL people are held to a standard of honesty, ethics, and morality, whereas progressives, being AMORAL by choice, seem to believe there are no standards for them.

                • All that said, I do believe that Barry is ineligible, just going by what he wants us to believe about his origins. Ditto for Cruz, imho. How can a person born in another country to only one citizen parent be an NBC? (I hope I’m right on his parentage. I get mixed up with all these potential ineligible people.) Can’t we settle on somebody who’s without doubt eligible, like West or Carson? There are many others, too, like Trey Gowdy.

                • Often, stories have links to the original, so that is what I link to. Most of the time CTH/SD is the broker or middle man of articles presented to look like SD wrote, whether intentional or not, who knows?. To be fair to him, he does now link, almost obsessively to original stories and sometimes he sends you right to the originating site. Since he uses other peoples news and stories to bring traffic to his site for an opportunity to influence as to the correct conservative thinking, I link to where real credit is due. They did always have advertising and that did not change their format. I repeat I am not offended and I do not expect people to take sides and place loyalties as we are not in third grade. I have many friends, and even family that would not be caught dead in the same room with each and yet I have a relationship with each. That was a reason I disengaged ties with that group. They would check who was still visiting another blog and decide they were undermining the cause (who knows what the ’cause’ was supposed to be; was not to expose Barry, that is for sure. lol). That is not my style nor my comfort zone. I believe all who disengaged from the swinging vines of the forrest are of the same opinion and still hang out with those that still hang out over there. (How’s that for a tongue twister?) So, keep doing what you are doing.

                  One indication that people are self-silencing or being silenced on the issue is, well, let’s use the recent CTH article as an example. Very few comments and no real discussion going on. People hold back knowing the one held in high esteem disapproves. SD uses Alynski tactics. It is his blog, his right, his style, his schtick.

Also, read the response was not to disagree but an attempt to interpret for readers what justafly was trying to say. To show this, read from March, all the way to end and see how nasty Admin Stella turns. on justafly. The thing is I remember (may even have in private writings, those admins including SD accepting nbc as “born of two parents”.

                  I am not offended you and others post from over there. Sometimes just need a break from it. I don’t think CTH are coooool, but many conservatives do and think they are truth bearers and constitutionalists and trustworthy. As to Cruz being honest. He has had many, many citizens send him all the facts and proofs necessary to see he is not constitutionally qualified and yet, he gives the impression he would run. I would bet he was even taught, as I was, two citizen parents at birth. Say, in the long-shot that he does not understand the very clear Constitutional requirements (they only became hard to interpret when the Left said it was not cut and dry and confusing. Thus that became the reality. Gaslighting.), then he is not as smart as everyone says he is because he can’t understand what we all learned and comprehended in third grade.

I would say it’s FR’s right to do so, but they also ought to have an option where people can get a refund of donations, IF they thought they were supporting a FREE FORUM that turned out not to be so free. I wonder if anybody’s ever asked for a refund. I know of at least one person who donated there and has recently been treated like a piece of garbage. It’s their loss. I wonder if that’s why their recent fund raiser was “only” for $85,000 and not six digits. Who knows? They could easily say they hit their goal and who would be able to say, true or false?

As for Cruz, it’s possible he’s playing a game to keep the DemoncRATS on their toes, running interference, so to speak, for those who may actually run. Has he ever said he would?                     What’s instructive with regard to the discussion of NBC: The Naturalization Act of 1790 was RESCINDED/REPEALED a few years later, when the CONGRESS (note: not a Constitutional Amendment) realized what they had said with regard to the definition of NBC.

                    Of what use is citing a law that has been repealed? In the law of 1795, they reverted to the older understanding–the person born abroad to a citizen father could be a citizen, but not a NATURAL BORN one.

                    Since no law trumps the Constitution, it doesn’t matter how the hell Congress defines anything, although the guys in the 1700s were more likely to grok the Founders’ intent. Maybe they heard from some of the Founders and decided to repeal, post haste!

                    Only the SCOTUS can define for us what NBC means, keeping in mind that so far what they have said tends to agree with your take on it. But when there’s an issue of interpretation, they’re the deciders and so far they haven’t. TO OUR DETRIMENT. Since that is so, we just may have to accept and make the most of the unofficial precedent. However, it won’t happen because the left, who despise “birthers”, will suddenly become birthers if it’s a way to stop a conservative from winning the presidency. They believe that only conservatives can be “hypocrites”. That’s because since they’re amoral, and since they have no standards, they can’t, by definition, be hypocrites because they believe in nothing.

    Several interesting things in that article. First, that the VA modified the computer programs for scheduling to allow them to “cook the books” by turning off the “audit function” making it impossible to identify who was doing the cooking. This reminds me so much of how the Obama campaign modified the campaign donation software to eliminate the checks (the audit function) that would keep FOREIGN donations from being collected. Same M.O. Second, as I alluded to in another comment about how Barry doesn’t want to upset “his people” by correcting their errors and their cheating and making them work: the public employees BELONG TO SEIU or AFSCME (another UNION). Third, there’s a photo of Barry at Harvard that I’ve never seen before. Where’d that one come from?

    Like the military that he ostensibly “leads”, Barry doesn’t believe in laws–he believes that by issuing a “signing statement” he can give himself permission to ignore the laws passed by the representatives of THE PEOPLE. The military, of course, believes it can give itself permission to give itself its own orders to attack U.S. citizens whenever they have decided that the citizens are engaged in domestic “unrest” or “disturbances.”

  26. Guys, I’m freaked out again. Any advice on what I should do. I’ve watched twice today on my computer where McAfee protection software was shut down. I’ve managed to get it back on by shutting down and restarting my computer a couple of times. I then ran McAfee virus scan and it came up with nothing. This is not the first time this has happened. Any ideas how they are getting in or what steps I should take for protection? I detest what has become of our world!

    • Get rid of McAfee. However, in this case I do not think it is MacAfee as the same things and stranger have been happening over here. Everytime I come here my browser tabs just keep blinking/flashing and everything gets jammed.

This power grab is coupled with POTUS recently announcing that he’s slashing the budget and personnel for all of our states’ National Guard. Fundamental transformation everywhere.
