Arizona’s Governor Jan Brewer Vetoed a Bill SB 1070 that Required Candidates Prove They Meet the Constitutional Requirements for President!!

PHOENIX (Reuters)    Arizona’s Republican Governor Jan Brewer on Monday vetoed two controversial bills, one mandating proof of U.S. citizenship to run for president, the other allowing guns on college campuses, in a clear setback for conservatives who control the state legislature.   Brewer, who grabbed headlines a year ago when she signed a get-tough state law cracking down on illegal immigrants, vetoed the bills in an announcement late on Monday.

The so-called “birther bill,” would have made Arizona the first state in the nation to require presidential candidates prove U.S. citizenship by providing a long form birth certificate, and other forms of proof including baptismal or circumcision certificates, to be placed on the state ballot.

“I never imagined being presented with a bill that could require candidates for president of the greatest and most powerful nation on earth to submit their ‘early baptism or circumcision certificates’ … This is a bridge too far.”

A former Arizona secretary of state, Brewer said, she did not support designating one person as “gatekeeper to the ballot for a candidate,” as it “could lead to arbitrary or politically motivated decisions.”

The Republican-controlled state legislature passed the measure at a time when some foes of President Barack Obama, a Democrat,  question whether he is a native-born [NATURAL BORN] U.S. citizen. Real estate mogul and television reality show host Donald Trump is among those questioning Obama’s birth in Hawaii.

On Greta Van Susteren’s show,  Governor Brewer announced that she had vetoed the bill.   She said, “This bill is a distraction and we need to get on with the state business.”   The Governor also said she would be sending a letter to the legislature.  It will be interesting to read.   The Tucson Sentinel reported that Brewer said that HB 2177   “creates significant new problems while failing to do anything constructive for Arizona.”

Is there anyone else that believes insuring that candidates meet the Constitutional requirements by providing proof of their qualifications  is a distraction?   What problems would there be?  Overseeing a few pieces of paper and determining their authenticity would be a problem?  For whom would it be a problem?

Isn’t the Secretary of State already a gatekeeper?  Isn’t the SOS  the one that receives the nomination papers from the candidates?  If the SOS isn’t qualifying the candidates, exactly what is  their responsibility to the electors?   Do they just receive a piece of paper and put a date stamp on it and send it to the file?  Is that the only thing they have to do?

Was the Governor threatened?  Did the Federal Government intervene and say that no federal funds would be going to Arizona if she didn’t veto the bill?  Why did she cave?

Earlier this afternoon, a spokesperson for the bill said there was a 50/50 chance for the bill to pass.  If it did not, there were plans to override her veto.   The bill was watered down from the original requirement, but it was a real start.    Will other states follow suit?  Will there be other states that are willing to uphold the Constitution?  We shall see.

We disagree, it would have been constructive for Arizona and for the U.S.!

 Gov. Jan Brewer had a chance to help save this country and She didn’t do it.   She didn’t do it.  She didn’t stand.

    Approved in the state legislature last Thursday, the bill called for candidates to produce two or more qualifying documents in the absence of a long-form birth certificate, which include a “hospital birth record, early baptismal certificate, circumcision certificate, early census record or postpartum medical record signed by whoever delivered the child,” the Arizona Republic reported.

    Thirteen other states have considered similar bills this year, and in addition to Arizona, the proposals have been shot down in Arkansas, Connecticut, Maine and Montana.

    It’s not clear whether the proponents of the bills completely understand the legislation they are trying to pass. In Arizona, for example, the bill would have potentially ruled out decades of legitimate citizens who don’t have the specified paperwork.

    “If the term ‘long form’ is taken literally, Arizonans born after 1966 may not have the required birth certificate as outlined,” the Republic reported.

    And in Tennessee last month, state Sen. Mae Beavers introduced a birther bill requiring candidates to have long-form birth certificates, but quickly admitted, “I’m not entirely sure what long-form means.”[Would someone from Tennessee send the woman some examples of the short form and long form BC please?     Obama has insisted that he was born in Hawaii, and the allegations against him have been repeatedly discredited in investigations by CNN and other organizations. Nevertheless, the issue remains politically potent among segments of the electorate and has served as a rallying cry for many of the president’s opponents, most recently potential GOP presidential candidate Donald Trump.

    Among other things, a candidate would have to show a copy of his or her birth certificate. If a birth certificate couldn’t be produced, a candidate would have to show a combination of baptismal or circumcision records, hospital birth files, postpartum medical records or other documents. Candidates also would have to submit affidavits declaring their citizenship as well as sworn statements regarding their residency for the previous 14 years.

    The author of the so-called “birther bill,” Arizona State Rep. Carl Seel, has said the bill was not targeted at Obama, but at “maintaining the integrity of the Constitution.”

    In an effort to counter the charges of the birthers, Obama’s 2008 campaign produced a “certification of live birth,” a document traditionally accepted legally as confirmation of a birth.

    Both the current Hawaii governor, Neil Abercrombie, a Democrat, and the previous governor, Linda Lingle, a Republican, have insisted that Obama was born in their home state.

    Nearly 75% of Americans believe Obama was definitely or probably born in the United States, according to a March 11-13 CNN/Opinion Research Corp. poll. More than four in 10 Republicans, however, believe the president probably or definitely was not born in America. [This poll was from what year? 75% what a lie!]

In our interview yesterday, he laid out a new condition for their release. “Maybe I’m going to do the tax returns when Obama does his birth certificate…I’d love to give my tax returns. I may tie my tax returns into Obama’s birth certificate,” Trump said.

Poor Arizona, and the problem border are kicked in the face again ? Nothing is real here ? I am in shock still. I was so hoping she was genuine…..I was so proud of her. Even after Mayor of Phoenix Phil Gordon’s laptop got stolen from his home in a suspicious home invasion, I thought Jan would help clean up Az. What happened ?

    So why did Steve Croft and “60 Minutes” do a proctology examination on claims made in Mortenson’s book, while giving the person who “merely” wanted to be Commander in Chief and the most powerful person in the world a pass? Why do they continue to refuse to investigate OBAMA’S claims in his two fictional books, which he claims shaped his life? Why do they not investigate Obama’s claims about the number of jobs he says he saved or created? The use of stimulus funds? The source of all his campaign funds? The FOREIGN sources of his campaign funds? His connections to known domestic terrorists, America-hating “preachers”, mobsters, and NWO-promoting billionaires?

    Maybe Mortenson’s mistake was that he didn’t put in the preface of his books that they’re FICTION, LIKE OBAMA DID IN HIS BOOKS.

  6. the birth certificate from Kenya has a footprint… seems like a pretty sure fire way of checking its legitimacy… it would put the debate to bed.

      Why not compare a current Obama footprint to the footprint on the Kenyan birth certificate?

    • Redpill, At the link you made a great point there;
      They should start over with the list of “acceptable documentation” from the Form I-9, Employment Eligibility Verification, but then remove from that list any documents that relate to resident aliens or naturalized citizens. And it must be clarified that Diplomatic Passports (like the one Obama has) are not acceptable because they are obtained without birth documentation.

      Start with the I-9 Form, and restrict the list to just those documents that can prove that a person is a natural born citizen of the United States. How could Brewer veto that, especially given her stand on enforcement of current Immigration Law?!?

      If you look at the things which are accepted as “proof” of the Obama birth narrative, (JPG images of a COLB and JPG images of newspaper birth announcements), none of that is considered “acceptable documentation” by an I-9 form.

      So why do people like Allahpundit, Ed Morrissey, and Michelle Malkin accept what is not accepted by current Immigration Law?

(unless inserted via cauterization by Brennan’s contract employee), it doesn’t matter what’s on any partisan blog or in a campaign ad. Obama had NEVER presented acceptable documentation to the PEOPLE, who, after all, are his BOSSES.

    After giving up on US and Israel ever confronting Iran, Saudi Arabia has gone out on a limb against the Obama administration to place itself at the forefront of an independent Gulf campaign for cutting down the Islamic Republic’s drive for a nuclear bomb and its expansionist meddling in Arab countries, debkafile’s Middle East sources report.

    Two US emissaries sent to intercede with Saudi King Abdullah – US Defense Secretary Robert Gates on April 6 and National Security Adviser Tom Donilon, who arrived in Riyadh six days later – were told that Saudi Arabia had reached a parting-of-the ways with Washington, followed actively by Kuwait, Bahrain and Oman.

    Abdullah said he could not forgive the Americans for throwing former Egyptian President Hosni Mubarak to the wolves in Cairo and for the unrest they were promoting against Arab regimes.

    Saudi Arabia was therefore determined to lead the Gulf region on the road to a confrontation with Iran – up to and including military action if necessary – to defend the oil emirates against Iranian conspiracies in the pursuit of which the king accused US-led diplomacy of giving Tehran a clear field.

    Monday, April 18, the foreign ministers of the Gulf Cooperation Council, GCC, asked the UN Security Council to take action for stopping Iran’s “provocative interference in their countries’ domestic affairs.” This “flagrant interference” posed a “grave security to, and risked flaring up sectarian strike, in the GCC countries.” The resolution went on to state: “The GCC will not hesitate to adopt whatever measures and policies they deem necessary vis-à-vis the foreign interferences in their internal affairs.”

    The phrase “measures and policies deemed necessary” is diplomatic parlance for a military threat. It implies that Saudi Arabia and the rest of the regional group are confident that together, they command the strategic resources and assets necessary for a military strike against Iran. Our military sources report that the Saudis are convinced that their combined missile, air force and naval strength is fully capable of inflicting in-depth damage on mainland Iran. Their message to Washington is that the Gulf nations are now making their own decisions.

    Iran has taken two steps in response to the Saudi-led Gulf challenge: Thousands of Iranian students, mobilized by the Revolutionary Guards and Basijj voluntary corps have laid the Saudi embassy in Tehran to siege for most of the past week, launching stone and firebomb assaults from time to time, but so far making no attempt to invade the building.

    Then, Saturday, April 16, the Iranian foreign ministry summoned the Pakistani chargé d’affaires to warn him sternly against allowing Saud Arabia and Bahrain to continue conscripting Pakistani military personnel. Tehran claims that by offering exorbitant paychecks, Riyadh has raised 1,000 Pakistani recruits for its military operation in support of the Bahraini king and another 1,500 are on their way to the Gulf. Iran also beefed up its strength along the Pakistani border to warn Islamabad that if it matters come to a clash with Saudi Arabia, Pakistani and its military will not escape punishment.

    King Abdullah first defied the Obama administration’s policy of support for popular uprisings against autocratic Arab regimes on March 14 by sending Saudi troops into Bahrain to prop up the king against the Shiite-led disturbances organized by Tehran’s Lebanese surrogate, Hizballah.

    This force has been expanded continuously, split now between units suppressing the uprising and the bulk deployed on the island’s coast, 320 kilometers from the shore of Iran. Saudi ground-to-ground and anti-air missiles have been transferred to the Bahraini capital of Manama and naval units, including missile vessels, positioned in its harbor.

    Monday, April 18, Bahraini Foreign Minister Khalid bin Ahmed Al Khalifa announced that Saudi and allied GCC troops would stay in the kingdom until Iran no longer poses a menace. “Gulf force is needed to counter a sustained campaign by Iran in Bahrain,” he said.

    Tehran-Riyadh tensions are rippling into other arenas: On April 11-12, the chronically disaffected Arabs of Ahwaz in the western Iranian province of Khuzestan (1.2 million inhabitants) staged a two-day uprising against the Iranian government. In their first crackdown, government forces killed at least 15 demonstrators before cutting off Ahwaz’s links with the outside world.       But listen again to what Justice Souter said…

    • What information did she have? How would it tarnish the state to ensure that all presidential candidates are eligible under the Constitution?

      Certainly, her argument that opening it up to review by one person makes it legally questionable because it makes the decision subjective and possibly political. But of course, the SCOTUS says it’s a political question, which is why they won’t touch it. And of course, this is what all Secretaries of State do, arbitrarily and politically, when they decide many things, such as who gets on a ballot, what the exact wording of a proposition will be on the ballot, etc.

      To hazard a guess at what information she has: Brewer knows that Barry has no long-form birth certificate. Barry can’t even produce a new COLB from Hawaii because it will not match what the one that he already put on the Web says (unless he can get a lot of officials in Hawaii to put their careers, reputations, possibly their freedom from criminal charges at risk). Barry would therefore try to present some of the “alternate documents,” such as proof of circumcision or affidavits from somebody like Abercrombie (which might be why he’s suddenly saying he saw baby Barry when) or a hospital record, all of which are not LEGAL documents and would have to somehow be vetted for authenticity. So it would be a can of worms when election official tried to authenticate whatever is presented. And it would open up the state of AZ to unrest, as well as the rest of the country, if blacks and Hispanics bought into the progressive LIE that all of this is just a RACIST plot. It’s a conundrum but hey! Do the RIGHT THING, JAN. Grow some. We thought you had some, but apparently not.

      I’d like to know, also, what Brewer “believes” that the Constitution says. Isn’t it kind of, like, KNOWN what the Constitution says, so nobody has to “believe” anything about what it TRULY SAYS.

  21. I saw Brewer on Greta Van Susteren’s show last night. She talked about being snubbed by Barry–left out, as were all border state governors–from a special meeting about comprehensive immigration reform, which Barry needs to ram through in order to get his sinking poll numbers with Hispanics to go back up. She said nothing about the so-called “birther bill”. While she still talks the good talk about securing the border and no amnesty, I cannot fathom WHY she vetoed that bill. All it does is require, as states are supposed to do, that anybody on a ballot meets the LAWFUL requirements set out for the position the person seeks. She has lost a lot of credibility. I don’t know how she’ll get it back. If ever.

    The Justice Department tells U.S. District Judge Susan Bolton in filings that Brewer’s counter-lawsuit raises questions of a political nature and that Bolton’s court wasn’t the right place to air Brewer’s grievances.

    Brewer’s counter-lawsuit claims the federal government has failed to protect Arizona from an “invasion” of illegal immigrants. It seeks increased reimbursements and extra safeguards, such as additional border fences.

    Bolton has put the most controversial parts of the immigration enforcement law on hold.

To the “birthers” and now Donald Trump: Constitutional law states that one is a citizen if the parents are married at the time of the birth, that one of the parents is a United States citizen and lived in this country for five years prior to their 14th birthday. It does not matter where in the world one is born if a parent meets these criteria. President Obama, who was born in Hawaii, could have been born anywhere. He is a citizen of this country.

    Very simple, SoS Ken Bennett wants to be governor in 2014. Certainly, career before country. Governor Brewer is protecting Bennett’s career and reputation of not being labeled as a so called birther. Candidate eligibility is not a distraction but it seems to have come down to one gatekeeper, …Governor Brewer.

    A republican faction who call themselves conservatives, McCainservatives at best, as followers of the McCain regime, controlled the outcome of the proof of eligibility bill. Ken [Mc]Bennett would make a fine governor, don’t ya think?

    My State Rep. said today in regard to the proof of eligibility bill, “We will have to start all over again next year as we ended session 5:28 am today.”

    SoS Ken Bennett can promulgate rules allowing for the proof of eligibility of any candidate. The certification of the names of candidates by the SoS for the ballot is a legal procedure. With an upcoming election in 2012, how can SoS Ken Bennett certify any candidate, whether eligible or ineligible, without a determination of the eligibility of candidates ? Does SoS Ken Bennett believe the actual ballot belongs to the political Party?

    Answers to these and many more questions must be weeded out before Mr. Bennett wants to be governor.

    Some Arizona officials are considering not having a Presidential Preference election this next year as a method of saving state monies.

    This means the 2012 candidates may not be signing a sworn statement that s/he meets eligibility requirements as required by the ‘promulgated’ Arizona Presidential Preference Election Candidate Nomination Paper to self nominate themselves, for whatever that is worth. For the 2012 general election, the SoS can only rely on the certificate of nomination of a private political Party (being the traditional method) to place the names of candidates on the ballot.

    Arizona Governor Jan Brewer let down those of us who are determined to make Obama comply with the rule of law and provide proof of citizenship.

    Unlike Brewer Governor Jindal has a backbone and he will sign the bill that requires a presidential candidate to present a birth certificate before having his name added to the state`s ballot. If other states pass similar legislation, Obama will be forced to release a valid birth certificate. If Obama fails to present a valid birth certificate, he will be exposed as the biggest fraud in American history.

    Jan Brewer is dead wrong, Obama`s missing birth certification isn’t a distraction. If Obama wasn’t born in the United Sates he`s an illegitimate president, and every action that he takes is a crime and an affront to the constitution.

    American patriots shouldn’t let Obama [the media, or Congress] get away with his arrogance and deception.
